I can't sell the house I inherited

Conveyancing Fri, 27 Jul 2012

Chris  from London

I am non-resident and my father lives in Spain. He has told me that he will leave me his house in his Spanish will but that I cannot sell it for ten years. Is this true?

Hi Chris

I understand what your father means, but it’s not that you can’t sell the house if he leaves it to you in his Spanish will, it is that there will be financial penalties if you do. You will be able to sell the house any time that you like, provided you can find a buyer of course. However, as he is a resident and will be leaving his house to a non-resident there will be more Spanish inheritance tax to pay if you do decide to sell within that time period. You will also have to pay interest on that tax too.
